These Terms govern your use of the WeDecide website, application, and services (the "Service") provided by WeDecide Now Ltd ("WeDecide," "we," "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service. 1. Eligibility You must be at least 16 (EEA) or 13 (UK/US) to use the Service. By using the Service, you confirm you have the legal capacity to agree to these Terms and will comply with all applicable laws. 2. Description of Service WeDecide is a civic intelligence platform that enables residents to view neighbourhood-level civic data, share civic feedback, and communicate with elected representatives. The Service includes citizen-facing features and institutional tools for public officials. 3. Accounts You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms. 4. User Content "User Content" means any text, voice recordings, messages, or other content you submit. By submitting User Content, you grant WeDecide a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, adapt, publish, and display it for the purpose of operating and improving the Service, including creating aggregated and anonymised analytics. You represent that you own or have the necessary rights to submit the content. Anonymous submissions cannot be retrieved, modified, or deleted after submission. You agree not to submit content that is false or intentionally misleading, defamatory, threatening, harassing, or abusive, that incites violence or discrimination, contains personal information about others without consent, infringes intellectual property rights, contains malware or spam, or violates any applicable law. We may review, edit, or remove content that violates these Terms, and may suspend or terminate users who repeatedly violate content standards. 5. Acceptable Use You agree not to use the Service for any unlawful purpose, attempt to gain unauthorised access to any part of the Service, interfere with or disrupt the Service, scrape or harvest data without permission, impersonate any person or entity, use bots or automated methods to interact with the Service, manipulate or artificially influence community data, or use the Service to conduct political campaigns in violation of election laws. 6. Institutional Accounts Institutional users (elected officials, council officers, candidates) must verify their identity and official capacity. Paid subscriptions are billed monthly or annually as selected. You may cancel at any time; access continues until the end of the billing period. Refunds are provided only as required by applicable law. We may change pricing with 30 days' notice. 7. Intellectual Property The Service, including its design, features, content, trade marks, logos, methodology, data models, and underlying technology, is owned by WeDecide Now Ltd and protected by intellectual property laws including copyright, trade mark, patent, and database right. You may not copy, modify, distribute, sell, lease, reverse engineer, or scrape any part of the Service without our written permission. Access to the Service does not grant any licence or right to use WeDecide's intellectual property except for ordinary personal use of the Service. Anonymised, aggregated data derived from User Content belongs to WeDecide. This data may be made publicly available, shared with institutional clients and researchers, or used to improve civic outcomes. Individual User Content remains subject to your privacy choices as described in our Privacy Policy. 8. Disclaimers The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy or completeness of any data or analytics, uninterrupted or error-free operation, or that any representative will respond to your messages. WeDecide does not endorse any political party, candidate, or position. Nothing in this section affects your statutory rights as a consumer under the laws of your jurisdiction. 9. Limitation of Liability To the maximum extent permitted by law, WeDecide and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited by law. 10. Indemnification To the extent permitted by applicable law, you agree to indemnify and hold harmless WeDecide and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms. 11. Termination You may delete your account at any time via account settings or by contacting wedecide@pm.me. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination. 12. Governing Law and Disputes These Terms are governed by the laws of England and Wales. If you are a consumer in the EU or UK, you retain the protection of mandatory provisions of your local consumer law. We encourage you to contact us first to resolve any dispute informally. If that fails: EU/EEA consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/odr. UK consumers may refer disputes to an approved Alternative Dispute Resolution provider. US users agree that any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association, except for claims eligible for small claims court. US users agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration, to the extent permitted by law. All other disputes are subject to the exclusive jurisdiction of the courts of England and Wales. 13. Changes We may modify these Terms at any time. Material changes will be notified by email or in-app notification. Continued use after changes constitutes acceptance. 14. General These Terms and the Privacy Policy constitute the entire agreement between you and WeDecide. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. You may not assign your rights under these Terms. We may assign ours to any successor. We are not liable for failures caused by circumstances beyond our reasonable control. 15.
